    A HALF-ACRE OPEN MARKET NEAR PUNALU'U BLACK SAND BEACH is a new development proposed by Black Sand Beach, LLC on its 434-acre project site. The Open Market Conceptual Site Plan is included with the recent Special Management Area Permit application for Punalu'u Phase 1, submitted to County of Hawai'i for several projects proposed by the owner and its principal Eva Liu.
    The proposal says the Open Market, with its 33 tents, "will require clearing of existing vegetation and laying down of gravel to provide for a walkable site." It says the Open Market is anticipated to accommodate 20 individual 10' X 10' tents for a farmers market; eight individual 10' X 10' tents for retail activities; three 15' X 15' individual tents for retail activities; one 20' X 35' large tent for retail activities; and one 20' X 30' tent for visitor and entertainment activities. There would be two spaces for food trucks, plus portable restrooms. The proposal says the Open Market would be away from the shoreline, by some 200 feet.

     The proposal shows the location to be mauka of the oceanfront Dahlberg A-frame house and the Black Sand Beach, and makai of Jeanette Howard's home. It describes the site as "currently situated within an area that has been extensively degraded and modified as part of a homesite as well as the boundary of a portion of the existing golf course. The project site is presently covered in haole koa and coconut palm with an understory of guinea grass and various common weeds with no known encounter with federally listed threatened or endangered plant or animal species."
    The proposal says, "Site will be machine grubbed and graded to provide a level surface upon which aggregate will be laid to provide a walkable surface. The site gently slopes toward makai with an elevation difference of less than 10 feet, therefore not requiring intensive grading to accommodate the proposed Open Market site. All structures to be erected will be temporary in nature,  consisting of tents, mobile food trucks, and portable toilets."
    Black Sand Beach, LLC states in its proposal that "the Open Market is anticipated to be open seven days per week. When the open Market is not operating, then tents will be removed. Parking will be provided within the existing paved parking lot located across Punaluʻu Road that was once part of the former Black Sands Beach restaurant complex, which would create a central parking area rather than the haphazard parking that occurs along area roadways and within the beach itself."
    The proposal notes: "No improvements are proposed within the entire shoreline frontage of the project site that is situated within the State Land Use Conservation District. Since the shoreline frontage of the project site is also used by the County as part of the Black Sand Beach Park complex, facility and ground maintenance by County work crews continue on a daily basis."
    The proposal says "the estimated cost associated with establishing site for Open Market is $10,000." It is a portion of costs estimated by the applicants for multiple projects in the SMA application, with a total cost of under $500,000, which would make them eligible for a minor SMA permit, without a public hearing and consideration by the Planning Commission.
    Whether to approve a minor permit request would be determined by Planning Director Zendo Kern. The other projects in the less-than $500,000 budget include a Welcome Center across from the Colony One condominiums with a swimming pool, new tennis courts, camping sites, amphitheater, food establishments, and more. They also include cleaning up the restaurant and museum area next to Punalu'u Black Sand Beach pond, with the total budget under $500,000.

BUSINESSES WITH 100 PEOPLE OR MORE EMPLOYEES MUST MANDATE COVID VACCINES, or wear a mask and be tested once a week. The nationwide measure came from the federal Occupational Safety and Health Administration today as an Emergency Temporary Standard for fighting COVID. Exempted are people working remotely or exclusively outdoors and those with legally protected medical and religious reasons.
    OSHA's threshold of 100 or more employees applies company-wide, not each facility. The Emergency Temporary Standard does not require employers to pay for tests unless otherwise required by state or local law, or labor union contract. In Hawai'i, the governor's most recent proclamation states that private employers are not responsible for testing costs.
    Employers must provide up to four hours of paid time for workers to be vaccinated and ensure workers have paid sick leave to recover from any side effects that prevent them from working.
    Employers must comply with most provisions by Dec. 5 and with vaccination testing requirements by Jan. 4. Noncompliant businesses could face heavy OSHA fines.
Centers for Medicare & Medicaid Services and the federal Department of Health & Human Services also ordered all workers at healthcare facilities participating in Medicare and Medicaid to be fully vaccinated by Jan. 4, no matter the number of employees.
    Also announced is that the deadline for the federal contractor vaccination requirement is delayed from Dec. 8 to Jan. 4.
